Article 1 - Definitions
In these terms and conditions shall apply:

  1. EntrepreneurThe natural or legal products and / or remote services and consumer services;

Article 3 - Applicability

  1. These general conditions apply to every offer of the entrepreneur and any agreement reached at a distance between businesses and consumers.

Article 4 - The offer

Article 5 - The Agreement

  1. The agreement is subject to the provisions of paragraph 4, established at the time the consumer accepts the offer and meet the corresponding conditions.

  3.     d. the requirements for termination of the agreement if the agreement has a duration of more than one year or is of an indefinite duration.
  5. If the entrepreneur has undertaken to deliver a series of products or services, the provision in the previous paragraph only applies to the first delivery.
  6. The actual weight of delivered products may differ from the ordered weight if it concerns a weight-based item such as cheese. Cheese is a natural product that is cut to size fresh and by hand. Due to the nature of this manual process, it is not always possible to guarantee an exact weight. The deviation may amount to a maximum of 5% of the ordered weight, with both lighter and heavier results being possible. The price is calculated based on the ordered weight.
  7. Zuivelhoeve does not sell alcohol to persons under the age of 18.

Article 6a - Right of withdrawal upon delivery of products

  1. During the cooling-off period, the consumer will handle the product and the packaging with care. Article 6b – Obligations of the entrepreneur in case of withdrawal

The trader will reimburse all payments from the consumer, including any delivery costs charged by the trader for the returned product, immediately but within 14 days following the day on which the consumer notifies him of the withdrawal.   3. The entrepreneur uses the same means of payment used by the consumer for repayment unless the consumer agrees with another method. The refund is free for the consumer.
  4. If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, the entrepreneur does not have to reimburse the additional costs for the more expensive method.

Article 7 - Cost in case of revocation

  1. If the consumer makes use of his right of withdrawal, the costs of return will be borne at most. If the entrepreneur reports that the consumer does not have to bear these costs or if the entrepreneur indicates that he will bear the costs himself, the consumer does not have to bear the costs for returning the goods.
  2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than within 30 days after the return or cancellation.

Article 8 - Exclusion of right of withdrawal

  1. If the consumer does not have a right of withdrawal, this can only be excluded by the entrepreneur if the entrepreneur has clearly stated this in the offer, at least in time for the conclusion of the agreement.
  2. Exclusion of the right of withdrawal is only possible for products:
    a) that have been created by the entrepreneur in accordance with the consumer's specifications;
    b) which are clearly personal in nature;
    c) which by their nature cannot be returned;
    d) which can spoil or age quickly;
    e) the price of which is subject to fluctuations in the financial market over which the entrepreneur has no influence;
    f) for loose newspapers and magazines;
    g) for audio and video recordings and computer software of which the consumer has broken the seal.
  3. Exclusion of the right of withdrawal is only possible for services:
    a) concerning accommodation, transport, restaurant business or leisure activities to be carried out on a specific date or during a specific period;
    b) the delivery of which has started with the express consent of the consumer before the cooling-off period has expired;
    c) regarding betting and lotteries.

Article 9 - The price

  1. During the period of validity stated in the offer, the prices of the products and / or services being offered will not be increased, except for price changes as a result of changes in VAT rates.
  2. Notwithstanding the preceding paragraph, the business products or services whose prices are subject to fluctuations in the financial market over which the trader has no influence, with variable prices. These fluctuations and the fact that any price targets, are stated in the offer.
  3. Price increases within 3 months after the conclusion of the contract are only allowed if they result from legislation or regulations.
  4. Price increases 3 months after the conclusion of the contract are only permitted if the trader has agreed to this and:
    a) they are the result of legal regulations or provisions; or
    b) the consumer has the authority to terminate the contract by the day on which the price increase takes effect.
  5. The supply of products or services mentioned prices include VAT.

Article 10 - Conformity and Warranty

  1. The trader guarantees that the products and / or services meet the contract specifications stated in the offer, the reasonable requirements of reliability and / or usability and and on the date of the conclusion of the agreement existing legal provisions / or government regulations.

Article - Delivery

5.1. The delivery time shown is an indication and may therefore differ in reality. Goods will be delivered to the specified address.

5.2. On delivery by Zuivelhoeve or our delivery service, we will do our utmost to deliver the order on time. However, we exclude any liability with regard to late deliveries or deliveries made later than reported.

5.3. Zuivelhoeve will make every effort to deliver the order within the specified time. We are not liable for any loss or damage incurred due to late orders. If the goods are not delivered within the time specified by us, please contact us.

5.4. If an order does not arrive on time or does not arrive at the agreed time, the delivery costs will not be refunded.

5.5. At the moment an order is handed over, all risks of goods and/or services are transferred to the recipient of the order.

5.6. If the consumer is unable to receive the order, we will not be able to deliver it at the specified time. If this is due to the lack of clear instructions and/or authorization from the consumer, the ordered goods will be regarded as delivered and all risks related to these goods will be transferred to the consumer. All costs, such as storage and/or insurance costs, that we incur in connection with failure to receive the goods on time must be fully reimbursed by the consumer.

5.7. The consumer must make the necessary preparations to ensure easy and safe delivery of the goods. We exclude all liability with regard to damage and/or costs incurred to the ordered goods when this is the result of the consumer's failure to provide access and/or to make sufficient preparations for delivery.

5.8. Zuivelhoeve strives to:

deliver the order to the specified address;

within the specified time;

inform the consumer when it is expected that the order will not be delivered within the specified time.

5.9. Zuivelhoeve excludes all liability for loss, costs, damage, responsibilities, liabilities, charges and expenses as a result of (too) late deliveries, except for the liability for damage resulting from intent or willful recklessness on the part of us or our managerial subordinates.

5.10 When selling alcoholic products, deliverers will ask for identification. If the minimum age requirement (18 years) is not met, the deliverer is unfortunately forced to take the order back or deliver it to a parcel point. The deliverers also ask to sign for receipt of the order.

Article 12 - Duration transactions

  1. The consumer can cancel an agreement that has been concluded for an indefinite period of time at any time with due observance of the agreed termination rules and a notice period of at most one month.
  2. The consumer can terminate an agreement that has been concluded for a definite period and which extends to the regular delivery of products (including electricity) or services, at any time by the end of the stipulated term, with due observance of the agreed cancellation rules and a notice period of at least highest one month.
  3. The consumer can agree the agreements mentioned in the previous paragraphs:
  4. Terminate at all times and not be restricted to termination at a particular time or in a certain period;

Article 13 - Payment

  1. Unless otherwise agreed, the amounts owed by the consumer must be paid within fourteen days after delivery of the good or in case of an agreement to provide a service, within 14 days after issuance of the documents relating to this agreement.
  2. When selling products to consumers are stipulated. In terms never a prepayment of more than 50% If payment is agreed, the consumer may not assert any rights regarding the execution of the order or service (s) before the advance payment has been made.

Article 14 - Complaints

  2. Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, the entrepreneur will reply within the 14 period with a message of receipt and an indication when the consumer can expect a more detailed answer.

Article 15 - Additional or derogatory provisions

Additional or different provisions of these terms may not be to the detriment of the consumer and should be recorded or in such a way that they can be stored on a durable medium. Consumers in an accessible manner

Article 16 – Intellectual property

All intellectual property rights with regard to this website, including in any case but not limited to logos, software, texts and images, are vested in Zuivelhoeve or with companies affiliated with it and/or with those from whom it has obtained a license.
